Oικουμενικό Πατριαρχείο Vs ''KALAMI.us''

Στις 5 Ιανουαρίου 2022, το kalami.us και ο εκδότης του, έλαβαν -με ένα χρόνο καθυστέρηση στην επίδοση- ''εξώδικο'' από τον ''μητροπολίτη -γέρων- Χαλκηδόνος'' (πρώην ''Γαλλίας'') Εμμανουήλ και τον επίσκοπο ''Μελιτηνής'' (πρώην Παρισίων) Μάξιμο, γιά δημοσίευμα Μαίου 2019, σχετικό με σκάνδαλο στην μητρόπολη Γαλλίας (Παρίσι), όπως αυτό καταγράφηκε και στα ''πεπραγμένα'' της γαλλικής αστυνομίας. Το πρώτο ''εξώδικο'' στα 28 χρόνια ύπαρξης του kalami.us.

Οι δύο κληρικοί τoυ παριαρχείου Κων/πολης, δεν γνωρίζουμε (ακόμα) αν είχαν την άδεια-έγκριση από την σύνοδο Πατριαρχείου και τον Βαρθολομαίο, γιά να στείλουν ''εξώδικο'', με ''απαιτήσεις'', έμμεσο υβρεολόγιο (που θα έχει νομικές συνέπειες και γιά το πατριαρχείο) και ''απειλές''.

Οι δύο κληρικοί του πατριαρχείου Κων/πολης, απαιτούν ολική (!!!) απόσυρση όλων των σχετικών δημοσιευμάτων και αισθανόμενοι ότι ζουν ακόμα στην σκοταδιστική, παπαδο-αυταρχική, ελληνοκτόνο ''βυζαντινή αυτοκρατορία'', με μιά εντυπωσιακή θρασύτητα, απαιτούν και δουλοπρεπή ''συγγνώμη''. Στο εξώδικό τους, γίνεται συνειδητή προσπάθεια μείωσης και απαξίωσης του kalami.us και του εκδότη του, με αναφορές σαν κι αυτή:

Το kalami.us έχει έδρα τις ΗΠΑ και λειτουργεί με τους νόμους των ΗΠΑ, όχι Ελλάδας ή Τουρκίας. Οι ''θιγόμενοι'', και οι δύο ''εκλεκτά μέλη του κιναιδείου Βαρθολομαίου'', ουδέποτε έστειλαν email στο ''ΚΑΛΑΜΙ'', γιά διόρθωση αν είχε κάνει κάπου λάθος.

Στο ''εξώδικο'' (που ήταν στα ελληνικά και στα αγγλικά) απάντησε γιά λογαριασμό του kalami.us, ο δικηγόρος (αδειούχος, ΗΠΑ και Ελλάδα) κ. Δημήτριος Καυκάς (Βοστώνη), που ανάλαβε και την υπόθεση. Το ''ΚΑΛΑΜΙ'' θα ασχοληθεί με τους ''κληρικούς'', όπως αυτό ξέρει. Γιά τώρα διαβάστε ολόκληρη την απάντηση του δικηγόρου στο ''εξώδικο'':

RE: EXODIKO / Demand Letter to Kalami.us and Georgios Lykomitros

Dear Attorney Athanasopoulos:

From one colleague to another, Happy New Year.

I represent the above referenced as it relates to a Demand Letter (of one year ago) you caused to have served recently for publications of three years ago pertaining to two members of the Holy Synod of the Ecumenical Patriarchate of Constantinople.

First, by no way or means is this communication a recognition of the jurisdiction of the Hellenic Courts or of the EU Courts in general over this matter. Rather it is a communications to put things in a proper spectrum.

Kalami.us is as you are fully aware a entity registered and located in the United States of America and a interactive computer service provider and as such is protected under the First Amendment of the USA Constitution. The freedom of the press, protected by the First Amendment, is critical to a democracy in which the government is accountable to the people.

Furthermore, Section 230 of the Communications Decency Act of the Federal government in the USA provides “No provider or user of interactive computer service shall be treated as the publisher or speaker of any information provided by another provider”. This Section, in short protects and immunizes Kalami.us. In this context, you are fully aware that the articles you and your clients claim offensive were written and provided by Nicholas Stamatakis, a religious expert of sorts, who for reasons you and your clients choose not to challenge or contest.

Also upon information and belief your clients are not private individuals but public figures on the direct or indirect payroll of the Greek government and to wit an extension of it and at the very least are quasi governmental employees, considering compensation, health and pension benefits. The United States Supreme Court has repeatedly rule that speakers are protected against all government agencies and officials.

Kindly provide any proof to support your claims so that Kalami.us may consider your demands. Such as, police and insurance reports from Paris, France pertaining to your clients and the alleged incidents of the specific time frame. Generic accusations and demands without supporting documentation is deficient per se. Again this is not a recognition of any judicial process outside of the United States.

Now on to another more germane matter which is the hubristic and vitriolic context of your purported Demand where you as an attorney, without proper due diligence you incorporate allegations that my client, Georgios Lykomitros was charged with attempted manslaughter of his son! and also has had seven criminal cases against him! (σ.σ. ''Κ'':... ''μπήκε 7 φορές φυλακή γιά ψευδείς ειδήσεις'' - ο εκδότης του ''Κ'').

This not only you transcribe but you then have translated by the Hellenic Ministry of Foreign Affairs and proceed to distribute to multiple third parties. Do you care to provide a renunciation and apology yourself since you callously transcribed such knowing or having the ability to know the falsity of said statements which are simply stated to demonize and discredit my client and his platform and not for the truth.

My client reserves his rights to seek satisfaction for said acts within the legal parameters against all parties including yourself which means you may have a potential conflict of interest to further represent your clients.

In closing you transcribe a Exodiko in February of 2021 on behalf of clients you refer to as Episkopes of France when at the time of your Exodiko they were not, but rather direct member(s) of the Holy Synod of Constantinople. In their capacity as religious leaders under the Ecumenical Patriarchate were you provided with any letter of authority or capacity with permission from the Holy Synod to send this Exodiko? Or other words, did the Holly Synod convene and vote on a Exodiko to be sent by you on behalf of these individuals in their ''official capacity" or again is this overreaching and stretching by them and you under the colour of title?

A reasonable person and most legitimate legal venues would task your clients for three years after a publication questioning its credibility and would certainly be aghast at the fact that you do not question or put to task the arthographo itself.

Again, if your clients are sincere my client is happy to receive via my office any and all documents that tend to support your clients position. The police report, and insurance claim report is worthy of dispelling things as a start before ultimatums are thrown vicariously.
